ILLINOIS BANKRUPTCY COURTS
Individuals can file bankruptcy on US bankruptcy courts without having the assistance of an attorney. This process of representing yourself is know as Pro Se (Lating for "by yourself/for self/on your own behalf.") By choosing to represent yourself, you will be a PRO SE litigant. By choosing Do-IT-Yourself filers can save the money that would be necessary to hire an bankruptcy attorney. The cost to file on your own ranges from $200 to $400 Dollars. It will include filing fees, trustee surcharge, and administrative fees. Most courts have created Pro Se desks or self-help desks to help you with forms and instructions. Clerks may provide information and the appropriate forms necessary, but are prohibited by law from giving legal advice or assisting, drafting or preparing legal documents. Unsecured debt such as credit card bills, personal loans, utility bills, etc can be filed under the bankruptcy law. Time of discharge is 3 to 4 months. Bankruptcy will remain on your record for 10 years after the date it was declared. Corporations are not allowed to file bankruptcy without legal counsel.
